The following action minutes are listed as they were acted upon by the Imperial County Transportation Commission and as listed on the agenda for the meeting held Wednesday, June 22, 2022, together with staff reports and related documents attached thereto and incorporated therein by reference.

I.                    CALL TO ORDER AND ROLL CALL 

Chair Nava-Froelich called the Commission meeting to order at 6:03 p.m. Roll call was taken, and a quorum was present.

II.                  ACTION CALENDAR

A.                  Adopt resolution authorizing remote teleconference meetings in accordance with Assembly Bill 361

1.            Approved the resolution of the Imperial County Transportation Commission authorizing remote meetings in accordance with the provisions of the State Assembly Bill (AB) 361.

2.            Authorized the Chairperson to sign the resolution.

III.                 EMERGENCY ITEMS

                There were none.   

IV.                PUBLIC COMMENTS

It should be noted that brief summaries are provided of comments made:

1.                   Diahna Garcia Ruiz resident and postmaster of Heber. Ms. Garcia Ruiz present to complain about illegal parking by semi-trucks on sidewalks in Heber, referred by the CHP.

2.                   Daniela Flores resident of Calexico. Ms. Flores present to show discontent about the change in ICTC Chairperson.

3.                   Sergio Ojeda concerned citizen. Mr. Ojeda present to show discontent about the change in ICTC Chairperson and support Councilmember Urena.

4.                   Gonzalo Gerardo, retired Chief of Police, City of Calexico. Mr. Gerardo present to show support to ICTC. ICTC was also commended for leadership and for all transportation projects that have occurred in the City of Calexico.

5.                   Gloria Romo Calexico City Council Member in Spanish. Ms. Romo present to show discontent of the recent actions conducted by ICTC to change the chairperson from the City of Calexico to City of Calipatria.

6.                   Alma Castro resident and business owner in the City of Calexico. Ms. Castro present to state that Mr. Urena is supported by the community and received plenty of votes. Is also asking for support to the City of Calexico in the form of transportation services. No services currently available according to the statement.

7.                   Olga Raggio, representing seniors in the City of Calexico. Ms. Raggio present to state that she is struggling with transportation services. Issues She is currently paying $5 for taxi services, and according to Ms. Raggio this is the only transit service available in Calexico. She supports Mr. Urena and believes he can be on the ICTC Commission.

8.                   Marlene Thomas member of the public. There are stereotypes and biases against Mr. Urena, however Ms. Thomas was present to state that he is qualified and has great knowledge on the transit system and shouldn’t be challenged for being on the board. We should see the value of how all people bring to the table. Regarding the history of transportation, Ms. Thomas stated that no one would be here if it wasn’t for the City of Calexico. She stated the various past systems and how it begun in the City of Calexico to Imperial Valley College. Lastly, if the Brown Act was violated, then it should be addressed.  

9.                   Raul Urena, current ICTC Commissioner resident of Calexico. Mr. Urena stated that he is a person with a disability and therefore is asking for 4:30 minutes to speak. Attention to the Bylaws of the ICTC, Article 6a. was stated. In summary, Mr. Urena had a real issue with the posting of the minutes, the unavailability of video recordings of meetings and translation services.  Several other comments were made my Mr. Urena regarding his discontentment with the Commission.

10.               Javier Gonzalez, current ICTC Commissioner. Mr. Gonzalez stated that he disagrees with the various comments regarding ICTC. Mr. Gonzalez has visited the Calexico City Council as a representative of IID and ICTC many times to discuss issues.

11.               Ismael Arvisu resident of Calexico. Mr. Arvizu present to ask why the Chairperson role was taken away from the City of Calexico.

12.               Armando Marquez-Romero stated that he would like to give his time to member of the public that has already spoken.

13.               Rosie Arreola-Fernandez, Calexico City Council Member. Ms. Arreola-Fernandez stated that she did the best that she could as the Chair as ICTC. She stated that she was discriminated for being older by the Mayor of Calexico as demonstrated by her removal of the ICTC seat. She thanked ICTC for all the support and stated that staff was always very professional. Finally, apologized for the chaos coming from the City of Calexico.

The ICTC Management Committee met on June 8, 2022, and forwarded this item to the Commission for their review and approval after public comment, if any:

1.                   Authorized the Chairman to sign the STIP/RTIP Consultant Agreement with the firm of COH and Associates for the not to exceed fee of $20,000.00 effective July 1, 2022, through June 30, 2023.

A.                  Appointment of Vice-Chair Position

It was requested that the Commission take any appropriate action in the consideration of the appointment of a new Vice-Chair for the remainder of 2022.

A motion was made to nominate Mike Goodsell (Holtville) to serve as the ICTC Vice-Chair for the remainder of the calendar year.

B.            Draft ICTC Overall Work Program (OWP) and Budget, Fiscal Year 2022-2023

Mr. Aguirre reviewed the budget worksheets with the Commission. A budget workshop was previously held on May 25, 2022. At the workshop Mr. Aguirre provided a PowerPoint presentation and described in detail all revenue and expenditure line items. 

The ICTC Management Committee met on June 8, 2022, and forwarded this item to the ICTC Commission for review and approval, after the receipt of public comment, if any:

1.                   Adopted the Draft ICTC Overall Work Program (OWP) and Budget for FY 2022/23.

C.            3rd Competitive Bid for the IVT MedTrans Paratransit– Public Outreach and Marketing Services – FY’s 2022-23, 2023-24, 2024-25

1.                   Authorized the Chairman to sign the IVT MedTrans Public Outreach and Marketing Consultant Agreement with the firm of Franklin Lee Enterprises L.L.C. dba CONVEYOR GROUP, for the not to exceed fee of $176,394.00, effective July 1, 2022, through June 30, 2023, with option to renew two one-year terms for fiscal years 2023-24 and 2024-2025. (amended)

An amended motion was made by Urena to the term of the agreement. The agreement was amended to state that the consultant agreement will be renewed for one year with an option to renew two consecutive one-year terms, and seconded by Walker, roll call:

1.            Authorized the Chairman to sign the IVT RIDE Public Outreach and Marketing Consultant Agreement with the firm of NSD Investments Inc. DBA Spectrum Advertising for the not to exceed fee of $207,400, effective July 1, 2022, through June 30, 2023, with option to renew two one-year terms for fiscal years 2023-24 and 2024-2025. (amended)

A motion was made by Viegas-Walker to the term of the agreement. The agreement was amended to state that the consultant agreement will be renewed for one year with an option to renew two consecutive one-year terms, and seconded by Goodsell, roll call:
